为了加强涉外法治人才培养,中国政法大学全面依法治国研究院自2020年9月启动“中国法英文视频公开课项目”。在我校宣传部、教务处、网信办等部门支持下,《中国商标法最新亮点》由中国政法大学全面依法治国研究院出品,由我院副教授张南博士撰稿并以英文讲述。我院的另一部视频《中国专利法最新亮点》曾经获得获得中国国家知识产权局知识产权类视频作品征集活动一等奖和最佳人气作品奖。
本视频主要由四部分组成,第一部分回顾中国首部商标法的颁布和过去四次商标法修正的时间。第二部分用例子生动地展示中国地理标志产品往往带有商标和地标两个标识。第三部分聚焦第四次商标法修改中最重要的条款之一——第六十三条并逐款展开分析,强调权利人需要注意商标侵权赔偿的计算方式、法定赔偿额度的变化和惩罚性赔偿的上下限。第四部分指出进中国商标法最新亮点旨在进一步维护国内和国外商标权人的合法权益、加大对商标侵权违法行为的惩治力度。
The Highlights of PRC Trademark Law
In order to strengthen the training of foreign-related legal talents, the Academy for the Rule of Law at China University of Political Science and Law has launched the project of “Chinese Law online Open Course in English” in September 2020. With support from the Publicity Office, Academic Office and NSIO of our university, The Highlights of PRC Trademark Law is produced by the Academy for the Rule of Law at China University of Political Science and Law, written and presented by Dr. Zhang Nan, an associate professor from this Academy. Another video, The Highlights of PRC Patent Law, produced by this academy has won the First Prize Award and the Most Popular Work Award in the Intellectual Property Video Contest run by China National Intellectual Property Administration (CNIPA).
This video is composed of four parts. The first part reviews the promulgation of China’s first trademark law and the timeline of the past four amendments of the trademark law. The second part uses an example to vividly demonstrate that Chinese geographical indication (GI) products often contain both trademarks and GI marks on them. The third part focuses on the latest amendment of Article 73, one of the most important changes in the fourth amendment, and analyzes it line by line, emphasizing that the trademark right holders need to pay attention to the calculation method of trademark infringement, the change of the range of statutory damages and the upper and lower limits of punitive damages. The fourth part points out the latest highlights of China’s trademark law, which aims to further safeguard the legitimate rights and interests of domestic and overseas trademark right holders and increase the punishment for infringement of trademark right.
